FOIA Updates Effective January 1, 2026
Effective January 1, 2026, amendments to the Illinois Freedom of Information Act approved by the General Assembly and signed into law by Governor JB Pritzker introduce new provisions to assist public bodies in managing FOIA requests and addressing cybersecurity concerns.
Key updates include:
1. Verification of Requesters
If a public body has a reasonable belief that a FOIA request was not submitted by a real person, it may require the requester to verify either orally or in writing that they are an individual. If verification is requested within five business days, the response deadline is paused until verification is received. A request may be denied if verification is not provided within 30 days.
2. Electronic Requests and Attachments
Public bodies are not required to open or access electronic attachments or hyperlinks included in FOIA requests. If a request relies on attachments or links, the requester will be notified within five business days that all request details must appear directly in the body of the request.
3. Clarification of Public Records
Junk mail, defined as unsolicited commercial mail that is not responded to by a public body, is not considered a public record under FOIA.
